Day 26 (Day 22 since testimony began, Day 8 of deliberations) Danny Masterson retrial
We noticed both Tom Mesereau and Sharon Appelbaum, Masterson's previous legal team, in the hallway. Each of them appear to have attorneys with them. This suggests to us that the evidentiary hearing may be taking place this morning.
SARTORIAL SPLENDOR ALERT: Defense attorney Philip Cohen is wearing an understated brown three-piece suit with purple shirt. On anyone else it would be a risky look, but for Cohen it's almost mundane.
The court clerk lets us in, and when we ask him if the evidentiary hearing is happening, he says "We'll see."
Mesereau and Appelbaum immediately go up to the clerk's desk. Then they and their attorneys sit in the Masterson section, which is otherwise empty.
Deputy DA Reinhold Mueller is in his usual spot at the prosecutor's table. Cohen and Holley at the defense table.
There are a couple of attorneys in the first row of the gallery who represent the Jane Does in their civil lawsuit.
Deputy DA Ariel Anson has arrived. The court reporter comes in.
Judge Olmedo arrives. We're on the record.
Karen Goldstein is on Webex.
Judge: I did have all four attorneys on Webex yesterday, and we discussed that it might be better to continue the hearing while the jury is still deliberating. I'm OK with that.
She says she wants to make it the least intrusive as possible. June 7 might work?
The attorneys agree. Appelbaum's attorney Crowley says that they're here from San Diego, can they appear by Webex? Judge Olmedo says she would rather they show up in person.
So June 7, 8:30 am, a week from today.
Again, the hearing will be inquiring into how the prosecution’s redacted discovery material (police reports, emails, texts and photos) which had been turned over to the defense then ended up in the hands of Scientology attorney Vicki Podberesky.
We told you earlier that Shawn Holley had seemed to suggest that the transfer of materials occurred under the previous legal team, Mesereau and Appelbaum, and the fact that they both showed up with legal counsel was very interesting.
Unfortunately, we’re going to have to wait a week for this show to go down.
On the other hand, we have not heard about any problems with the jury, and we were told that they will return to deliberating at about 9:30 am.
