JANE DOE 2 CROSS FINISHES QUICKLY: Danny Masterson Trial, Day 13, end of day report
[This report was produced live during a court hearing with a lot going on. There will be typos. Please don't email us about typos that you find.]
Late afternoon session.
Cross-examination of Jane Doe 2 continues.
Cohen: You had stayed at Masterson's house until about 5 or 6 am?
Yes.
And the two of you talked for much of that time.
For some of that time.
You previously indicated that the two of you talked about a lot of different things.
OK.
Did you talk about a lot of different things?
Yes.
When you said Masterson talked about himself, the two of you talked about more than just Mr. Masterson.
I guess so, yes.
When he said you are passionate, you agreed that you are passionate.
I am a passionate person, yes.
(He brings up romance and passion, and she says he's conflating things.)
After you left his house you believed he would call you.
Yes.
Did you believe he saw this as a consensual interaction? (Oblj, sustained.) YOu believed he would call you and ask for a date?
I believed that.
When he didn't call you, you reached out to him.
Yes.
You've been asked if you had feelings for him.
Can you repeat that.
When you called him you didn't have feelings for him.
I don't think so. I wanted it to be something it wasn't, so I might have felt many different things.
Was one of the things you felt that you hoped Masterson was going to like you.
Yes, so I wouldn't have to reconcile with what happened.
And you thought we're going to start dating.
Yes.
And when you spoke to Masterson and it sounded like he was abrupt with you, he basically says I'm busy and that's it.
Yes.
And that didn't make you feel good.
No, because I had to reconcile what happened. I was hoping, please don't let this be what it was.
Has anyone talked to you about this concept of taking something and making it what it wasn't? (Obj, overruled.)
I don't know what you're asking.
Well, you've been talking about processing and turning something into something it wasn't. Has anyone talked to you over the years about this?
Not really. I don't know in therapy or something. I've come up on my own that it's something I've done to cope
when did you come up with that?
I think it's just something I've come up with trying to understand something.
You said it had something to do with becoming a woman.
Sometimes I would blame myself, sometimes I would be very certain. It wasn't really a through-line until I reached a certain point.
I asked you earlier if you had flooded JD1 and JD3 with information. Do you recall telling Det Reyes that prior to going to LAPD that the three of you started flooding each other with your stories.
I don't really remember saying that, but if id that is fine.
If you did say it was it true.
We spoke, yeah. We really had to talk about what happened.
And that word flooding was yours.
Speaking a lot to support each other, yeah.
You mentioned a conversation with your mom. You were truthful with your mom?
I was, but I might have withheld things. It's my mom.
Did you tell your mom that you weren't happy with the way Danny had treated you?
I don't know if I used those exact words, but it was where I was getting yeah.
And this was after the call with Masterson. You then tell your mom that Masterson had treated you like a piece of meat.
I dont' remember saying that, but I told her it was really bad.
Did you tell her you wanted romance?
I don't know if I said that.
Would it be fair you never said anythign about violence to your mom.
Correct.
Nothing about rape?
The question you just said about violence, this is the problem. I'm misunderstanding what you're saying.
Would it be fair that you never mentioned violence in terms of violence by Masterson against you.
No, because I did descdribe how rough he was with me, and I told her I think about nearly vomiting and treating me roughly, and so I think that does speak to violence.
Did you tell your mom you were excited to go over there that night?
I don't remember.
At some point you told Det Reyes you told your mom.
Yes.
And she said she was going to talk to your mom.
I don't remember her saying that.
Well she did talk to your mom, right?
I don't remember.
Before Det Reyes talked to her, you spoke to her. (Obj, sustained) Did you call your mom to tell her about the conversation you had in 2003?
I don't recall.
You don't recall telling her that a detective was going to call her?
I don't know what I said to her, but I did not coach my mom, if that's what you're getting at.
I am just asking if you called your mom about what you had spoken of in 2003?
Not in the way you're saying. I told her a detective was going to be calling.
And you told her that Det Reyes told you not to talk to witness.
Yeah, but I might have misunderstood that, becasue I'm not in law enforcement. When I heard "witnesses" I guess I thought of victims. I wasn't thinking it in regards to my mom.
When you talked to Det Reyes, you didn't mention Jordan Ladd or Rachel Smith.
At that point I didn't remember it. It was the very first time I was remembering it.
Did you asked Rachel in 2017 to go to the press anonymously with your story?
No.
Did you speak with Rachel before she had been interviewed by LAPD.
Did you ever ask Jordan Ladd to go to the press anonymously.
She contacted me. She read in the paper, I have no idea where, somebody in the press had written there was an investigation of Masterson. And Jordan saw it and text me and said, I just saw something in the news about Danny allegedly raping women. And I wanted you to know I remember you telling me that and I wanted you to know I'm hear for you. I told her I was one of the women the were talking about. And she said she wouuld testify for me.
Did you ask Jordan Ladd to call the press anonymously on your behalf?
No.
No further questions.
REDIRECT
Mueller: You were asked about whether you made a statement to Det Reyes that it was your right to speak to whomever. What were the circumstances when you told her that?
At the time I remember was that I had emailed her and CC:ed Chief Beck and a detective, early on, people had contacted me and wanted to speak to them. People I had told much closer to it happening, they contacted me and wanted to talk to law enforcement, with witnesses. I'm sure with Jordan. Not sure with Rachel. But I had witnesses for her, and I would receive messages, no one has called me from LAPD. So I believe I called Det Reyes why she wasn't speaking to my witnesses. I thought that was very weird.
Is it in that context that she told you you couldn't talk to the witnesses.
Yeah.
With regard to interview with Reyes in 2017, where did it take place? Was it at the station?
My first interview with her was in my apartment.
Up until that time, had you been asked to discuss the specific details about what had happened?
No.
This is the first time when someone had a sit down interview with you asking you for specific details.
That's accurate.
And you say it was a 2.5 hour interview?
Yes.
You were asked about having discussions with JD1 and JD3. YOu said we had to talk a lot about what was happening. Did that include about concerns about the investigation?
Absolutely.
Did that include harassment, stalking, threatening?
Absolutely. We were all really scared.
Did you find some support that way?
One thousand percent.
I have no further questions.
No re-cross. Jane Doe 2 may step down.
(Seems like kind of a short cross compared to the previous two victims, even though in some ways Jane Doe 2's testimony was the most graphic and harrowing.)
Judge Olmedo: OK, this concludes testimony today. Full day tomorrow. Please avoid reading or listening to anything regarding this case, etc.
Bijou and a family friend were staring at your Proprietor intently as the jurors were going by. Got the distinct sense they were watching to see if I was winking at them or something. Sorry folks. Just a wan smile for the world.
