This week Leah Remini’s legal team submitted another set of evidence that she has done enough to serve Scientology leader David Miscavige with her lawsuit, which she filed on August 2.
Like the last time, she has submitted affidavits from process servers who documented all of the times in November and December that they attempted to find Miscavige at Scientology’s Hollywood Guarantee Building, which has entrances on Hollywood Boulevard and Ivar Avenue.
Miscavige was in England the first week of November to celebrate the IAS gala in East Grinstead, and for the past three years he appears to have been spending most of his time in Clearwater, Florida. But the HGB on Hollywood Boulevard is still the closest to an official address that Miscavige has, which is why Leah’s process servers have focused on it, attempting to complete “substitute service” on Miscavige by giving copies of the lawsuit to his employees there.
We thought you’d once again want to see the actual evidence that Leah submitted.
A hearing on Miscavige’s attempt to quash service is scheduled for February 14, at which time we’ll learn if Judge Randolph Hammock considers Leah’s efforts sufficient to consider Miscavige served.
That’s an interesting date, because it was last Valentine’s Day when a federal court in Tampa ruled that Miscavige was purposely evading service of a labor trafficking lawsuit, and declared him a defendant. (That case was later forced into “religious arbitration,” a ruling the plaintiffs are appealing.)
We’ll be very interested to see what Judge Hammock says about all of this effort to serve Miscavige on February 14. But before that, on January 9, there’s another big hearing scheduled in Leah’s lawsuit, when Scientology’s attempt to have much of the lawsuit stricken will be heard.
Here now is the evidence that Leah submitted, based on reports from several different hired process servers…
October 30, 10:45 am: 6331 Hollywood Blvd
I pressed the intercom button, it rang for about 1 minute then disconnected with a busy signal. I pressed the button again, it rang for another minute then disconnected playing a busy signal again. There is a yellow sign on the wall advising people not to enter if you are ill or have been around others who are ill. And to “Get the Receptionist's attention” to be screened with a no-contact thermometer. After I attempted at 1710 & 1719 Ivar Ave., I walked past the front of 6331 Hollywood and looked through the front window to the museum lobby and saw a man inside who quickly ducked and hid behind a partition when he saw me looking in.
October 30, 10:50 am: 1719 Ivar Ave
Just before I crossed the street to attempt at the delivery gate, I saw a silver Ford Explorer pull into the driveway and the gate close behind it. I crossed the street and pressed the intercom button, it rang for about 30 seconds then went silent. I pressed the button again, it rang for another 30 seconds, then went silent again.
November 2, 2:22 pm: 1710 Ivar Avenue
The intercom rang six times then a man answered "Hello" with an accent. There was also another voice speaking that sounded like a security person speaking to the man with the accent over the same line as I was trying to speak. I heard him say something about a process server. I said I am here to see David Miscavige, the man with the accent responded, you're here to see who? I repeated myself, and he said I'm sorry, I don't have anyone by that name here. I said the director of the COS - David Miscavige the security man's voice said something about - trying to go chaotic. The man with the accent responded - I'm sorry, I don't have such person that name, I said: David Miscavige, he said the person you are looking for is not here, does not live here, does not work here. I asked if he is affiliated with the COS or RTC? He said; again Sir, the person you are looking for is not here, does not live here, doesn't work here. I asked; do you know who he is? he said; yes I do Sir. I asked what relation he has to this building and the entities here? he said; the person, again, is not here Sir, does not live here and does not work here. I asked his name, he said Frank. I told him; I will now go to 6331 Hollywood, will you answer me over there as well? he said uh yes. I asked does it ring to the same place, he said yes it does.
November 2, 2:24 pm: 6331 Hollywood Blvd
Frank answered the intercom. I asked if both addresses / intercoms are for the same building, for Church of Scientology? He confirmed; yes. I asked Frank who he worked for, he responded, you know who I work for. I said that I was not sure because there are a couple of different entities at this building. He said I work for the Church of Scientology. I asked if David Miscavige was still not here? He said; again, as I said, we don't have such a name here, does not live here, does not work here. I said have a good day and left.
November 17, 4:10 pm: 6331 Hollywood Blvd
I pressed the intercom button, it rang for over a minute, then disconnected. I pressed the button again, same thing - rang and rang, then disconnected.
November 17, 4:13 pm: 1710 Ivar Avenue
I pressed the intercom button, it rang for about 30 seconds then disconnected. I pressed the button again, same thing - rang and rang, then disconnected. Through the blinds I could see a person’s legs approach the door, then they turned and walked away.
November 30, 10:48 am: 1710 Ivar Avenue
I pressed the intercom button, it rang for about 30 seconds, then disconnected but with no busy signal. The little blue light was still on so I said " Hello, Is David Miscavige here?" I got no response. I pressed the button again, It rang for 30 seconds then it went silent. There are signs on the wall instructing couriers what to do and where to go. One of them states that the front desk on Hollywood Blvd is open 24/7 if no one is available at the Ivar entrance. Another sign instructs deliveries to be made across the street.
December 4, 10:00 am: 6331 Hollywood Blvd
No answer on intercom. Waited 30 minutes for someone to come in or leave. No luck.
December 4, 10:30 am: 1710 Ivar Avenue
No answer on intercom. waited for someone to come in or leave. No luck.
December 6, 12:00 pm: 6331 Hollywood Blvd
Rang intercom, a woman came towards the window, once she saw me, she turned and walked away.
December 6, 12:15 pm: 1710 Ivar Avenue
Waited for someone to come in or leave. Rang intercom, no answer.
December 7, 3:30 pm: 6331 Hollywood Blvd
Sub Served to "John Doe", refused to speak to me. Hispanic male, 50yrs, 5'9", 160lbs, Gray hair, Brown eyes. I asked if David Miscavige was there, he turned his back to me and walked away as I announced that I was sub-serving him.
December 7, 3:30 pm: 1710 Ivar Avenue
Waited for someone to enter or exit, no luck. Rang intercom, no answer.
December 12, 9:45 am: 1710 Ivar Avenue
Sub Served to "John Doe", White male, 5'5", 38 yrs, 150 lbs, short blonde hair. I told him that I have a service for David Miscavige, he ignored me and rang the buzzer. I announced that I was sub serving him, he ignored me so I left the documents at his feet by the front door.
(The filing also indicates that copies of the papers were mailed to Miscavige at both 6331 Hollywood Blvd and 1710 Ivar Avenue.)

Good news.
Like Hubbard finally going into a complete seclusion the slimy little sleaze ball David MisScumbaggage will eventually retreat permanently. Like Hubbard he is a coward. And good for Leah, she has the courage and intention to right one of the huge wrongs of Scientology.
That process server is dogged. As that address is 'officially' a place of business for the RTC and David Miscavige, I consider the papers 'served'. I bet the judge has to find an alternate way to publish the summons. Too bad Mad magazine doesn't print any more. A back page 'fold up' summons would be hilarious.
