We’re reporting this morning from Judge Charlaine Olmedo’s courtroom, where we’re acting as pool reporter during the jury selection phase of Danny Masterson’s retrial.
What follows is the same report we sent out to reporters who had asked to receive a copy…
Danny Masterson Retrial, Day 3, jury selection
Pool report by Tony Ortega of the Underground Bunker
Part 3
Jurors 103-112 were brought in from the morning session.
I had notes on all of them, and then the notes program I was using crashed.
They are now talking about panels three and four, which are about to come in. The two sides have stipulated to excusing these jurors...
114, 117, 134, 137, 156, 161, 163, 173, 175, 178, 190, 197, 214, 141, 142, 122, 131, 133, 148, 165, 174, 205, 207, 215, 216
Jurors being brought in.
Judge Olmedo gives them the same speech about introverts and extroverts and how that affects people going through his process.
Tells them about the charges and the length of the case. About presumption of innocence, and reasonable doubt. Reads the witness lists.
Juror 97 (from the morning session). Man. So now that you'd heard the full introduction, do you think you could be fair. I feel like no matter what I might have some biases based on those allegations. (Based on things his family has been through.)
Juror 113. Woman. Retired teacher, taught elementary for 20 plus years. Significant other is a retired attorney, practiced family law and children's law, dependency court. Sexual incidents, open mind? I can do my best. Some concern? A little. I would be inclined to favor one side over the other. You have someone close to you who was involved in Scientology. You have some strong feelings about Scientology? Very strong feelings about Scientology. So this might not be the best case for you to listen to? It might not. I also need to tell you that I absolutely need not to be here tomorrow.
Juror 115. Man. Computer work. Fair? I won't be scared. But can you be fair? Yes, I can be fair.
Juror 116. Man. Have heard in the news a little about this case, but you don't know details. Only in passing. Fair to both sides? Yes.
Juror 119. Man. Worked for the federal government for 34 years. NASA, office of inspector general of JPL. Auditing and contract administration. Four juries. All of them quite a few years ago, Dodger stadium interfering with an arrest, drug buy. Civil cases: Medical malpractice, and a dispute over a house sale. Scientology, has seen some over the TV and read things over many years. All pretty much negative, and I think I might have heard about this specific case. It's been a while. Hard to say if he could be impartial.
Juror 120. Woman. "Go Bruins!" Have you ever treated a victim of sexual assault? Yes, I have. Would that impact your ability to be fair? I don't think so. On a jury for criminal case, in the 1980s, a drunk driving accident. Concerns over sexual or firearm evidence? I think I could be fair. Scientology: Just through the media, nothing personal. Just celebrities in Scientology. Not too much exposure. Fair? Yes. I should mention, forgot to mention on questionnaire, I wasn't raised by my father, but he did go to prison twice. He was out of my life after I was two years old.
Juror 121. Woman. Worked for a Scientologist dentist as a dental hygienist. Realized it later. He used to give us assignments from L. Ron Hubbard. Gave us the personality test. A room dedicated for learning. Didn't work there very long. Fair? Yes.

Juror 127. Man. Manufacturing, software company. Has limited exposure to Scientology, just hearing that it's a thing. Fair? Yes.
Juror 129. Man. Retired from chemical company in Gardena. DUI a long time ago. Arrest in 1990s might affect him. Domestic violence, that I forgot to mention. Does it bring back bad feelings to be here now? Yes.
Juror 130. Man. Two trials, both criminal? First one was grand theft auto, the second was a double homicide. And what do you do in your job? US Customs and border protection. He's sworn, federal. Fair? Yes.
Juror 132. Man. Has seen something about the case on Sunday night. That a jury would be sworn in this week. And here you are, Judge Olmedo says. Fair? Yes.
Juror 135. Woman. Worked for a law firm. What was the specialty? Business and corporate. Incident with niece 7 to 8 years ago, how old was she? She was a minor. Ten years old, but then trial when she was 17. Can you be fair? I'm not sure if I could be impartial. And a sister was attacked. It's not something they've recovered from. It's impactful. Also has a trip coming up.
Juror 136. Man. Works for LA Metro. Civil jury, contracts cases, about four years ago. Fair? Yes.
Juror 138. Man. Incident 20 years ago, was in Downey. Was it handled fairly? I don't feel comfortable here in court. Feels comfortable in a hospital, his job.
Juror 139. Man. Come into contact with police? Every day. Can you judge a police officer like others? Yes. Scientology, can you be fair? Yes. Fair to both sides? I'm not a fan of the celebrities being charged later in their career. He would lean toward the defense.
Juror 141. Man. Software developer. Situation last year, would it impact your fairness? No. Any ill feelings about how it was handled? It was fine. Aware of Scientology, but don't know much. Fair? Yes. Also, left off questionnaire: My father went to jail for drug transportation.
Juror 143. Woman. Can you evaluate sexual evidence fairly? No.
Juror 144. Man. Civil jury: Over 15 years ago, some kind of domestic issue. Familiarity with Scientology, general. Fair to both? Yes.
Juror 145. Man. Commercial law. Grew up partially in England. Some familiarity of Scientology, reading some articles. Some news stories about this case over time. Could be fair. But has a vacation scheduled.
Juror 146. Woman. Does interviews for benefits. Scientology, has heard about it. Fair? Yes.
Juror 147. Woman. What part of LA? Harvard private school, nurse. Treated any patients of sexual assault or rape? No. Criminal jury, 2018, rape case. Can you be objective about sexual assault case? Depends on the evidence. Works in Twin Towers.

Juror 155. Woman. Sworn federal agent? No, civilian. Asst to officers there. Anything about family members that would affect you? The subject would impact me. Because of your cousins? Yes, I grew up in the house where it happened. So you would have a hard time being impartial? Yes. Thank you.
Juror 157. Woman. Secretary for LAPD. Handles calendar, schedules lunches -- I have the fun job. Can you judge a police officer fairly? Yes. Has heard about this case on the news. Fair? Yes.
Juror 158. Woman. Retail, home goods. Criminal jury, five years ago, rape. Fair? Yes. She says financial hardship.
Juror 159. Woman. Criminal jury. Has heard very little about Scientology and a little about this case. Expressed negative feelings about being on a jury. Would rather not be on this jury.
Juror 160. Man. Fair to both sides? Yes. Going to be taking care of my parents, who are arriving May 8. So the case is too long. They're on vacation now. They're in mid 80s.

Juror 166. Man. Studied business administration. Then in medical transportation. Civil and criminal juries. Criminal was in 2000, about burglary. Another was workplace harassment. Familiar with Scientology, born in hospital in Hollywood, went there for doctor appointments. He seems to indicate some sort of harassment situation, but it's not clear. Fair? Yes.
Juror 167. Woman. Retired from federal govt, quality of life for armed services for more than 30 years. Scientology: What was your exposure: I've had a friend from school who married one. And being overseas tried various religions, but not Scientology. And from hearing about it. Fair? I would think so? But if it's about child sexual stuff, I've been robbed and (something). But I don't know what this case is. (She's rambling.)
Juror 168. Man. State of CA investigator. Sworn railroad bridge inspector. Good and bad experience with law enforcement, based on ethnicity. But with your description of the evidence, I can be impartial. The incident in 2015 with yourself, would impact you here? In my case, ten minutes on a computer they could see I was not a criminal.
OK, with that said, we're going to take a ten minute recess.
