Danny Masterson was handcuffed in court and led away to custody on May 31 last year after his guilty verdicts were read in Judge Charlaine Olmedo’s courtroom.
Since then, the That ‘70s Show actor and Scientology celebrity has spent time in Los Angeles Men’s Central Jail and three different state prisons, and today he’s at the Men’s Colony in San Luis Obispo serving his 30-years-to-life sentence.
That’s a total of 511 days he’s been behind locked doors, and we’re still waiting to see what his legal team is going to submit as an appeal brief to begin arguing for a new trial.
That appeal brief was due tomorrow. But yesterday, Masterson’s attorney Cliff Gardner, a post-conviction specialist, requested and was granted a 30-day extension to November 22. This was after several months of back and forth between Gardner and Olmedo’s court regarding a complete record of Masterson’s trial, including some transcripts filed under seal.
It’s not too surprising that Gardner needs a little more time, especially when you look at all of the other things he’s been doing lately. One of his cases has really blown up, as he’s part of the team representing the Menendez brothers.
Last week, Gardner and attorney Mark Geragos held a press conference in Los Angeles calling for the release of Erik and Lyle Menendez as prosecutors are reviewing new information in the case of their 1996 conviction for the 1989 murder of their parents Jose and Kitty.
Gardner has also represented Scott Peterson, helping him to get a death sentence overturned in 2020 and then an order for a fresh look at evidence in the case of Peterson’s conviction for the 2002 deaths of his wife Laci and their unborn child.
And the attorney represented Boston Marathon bomber Dzhokhar Tsarnaev, helping him to get a death sentence vacated that was later restored.
So Gardner has handled some very big post-conviction cases, and we’re interested to see what he will argue was done incorrectly in Danny Masterson’s trial by Judge Olmedo.
But we’ll just have to wait another month to find out.

This is crazy. Am wondering how Masterson could afford to hire Gardner, after he depleted so much of his assets throughout his whole case that led him to prison.
Guy Fawkes day is November 5, why try to overshadow it 2 days earlier? Fawkes day is a traditional day for bonfires and parties. Just another attempt to borrow some respectability.
