Continuing direct of Jane Doe 3.
Mueller: [Photograph of building, Celebrity Centre] Recognize that?
Yes sir.
What is that?
That is the Church of Scientology Celebrity Centre.
Is that you went to in Dec 2001 to report what happened?
Yes sir.
Why did you have to go here?
That's where we went. That was the church we would go to.
And Miranda and Chris Scoggins were both in this building?
Those things that Miranda told you, you believed her.
I did, yes sir.
The chaplain, Chris, did you believe him as well?
Yes sir.
Based on what they told you, were there certain things that you did or did not do based on what they told you?
Yes sir.
With regard to Chris Scoggins, he had directed you to read something.
Yes sir.
What was your understanding what that was?
What my "hat" or job was as his girlfriend. I was not fulfilling my duties.
When you say hat, you mean h-a-t?
Yes sir. It's a term that Scientologists use.
What did that mean to you?
Your job.
And what did he tell you was your job.
To give him sex whenever he wanted.
What was your understanding of why?
To keep my exchange in.
What did that mean?
He provides for me, and so I had to match that exchange. Kind of like a currency.
And that was something you were taught as part of a Scientology program?
Yes sir.
How did you feel about that?
At that point, I had almost completed my ethics program that Miranda put me on.
So before you saw Mr. Scoggins, Miranda had put you on a program for reporting?
Yes sir. When I reported it to her, she explained to me that there was no crime committed. And she told me that I had done something or was doing something to "pull it in." She had me read some things and then put me on an ethics program in order to get my ethics in, is how they say it.
What did she have you read?
High crimes and suppressive acts. I remember reading what suppressive acts were.
Had you heard that before?
Oh yes.
Did that have an effect on you?
Yes sir. I understood that it almost put me in a state of terror and I just needed to do what I was told to do and not to tell anybody.
What was your concern?
The handling for suppressive persons was what I had been living with for six years (getting emotional).
What were you worried would happen if you didn't follow the program?
They would destroy me.
For you what did that mean?
At the time he scared me. So I just did as I was told and I did the ethics program. (Shaking, trembling.)
If you were to have been declared a suppressive person, what impact would that have on you?
I'm afraid I would not have survived that at the time.
Why is that?
After what my husband and babies have been through the last six years, I would not have survived that then.
You OK?
(Trembling.) I'm trying to control my panic.
(Olmedo) You want a break?
I don't want to go out there. I don't want to go out there.
(Olmedo asks the jury to go into the jury room.)
I'm sorry. I'm so sorry.
Jane Doe 3 is having a full blown panic attack. She's still sitting on the witness stand, her advocate is trying to get her under control.
Olmedo calls for a sidebar while the advocate works with JD3.
Long sidebar. JD3 still crying softly with her advocate there.
Judge Olmedo checks on JD3. "I'm OK," JD3 says, not sounding all that OK.
Jury coming in. Starting up again.
Mueller: I wanted to ask you, when you went to report to Miranda and Chris Scoggins, did they have you prepare a report?
I was going to write a Knowlege Report...
What is that?
It's a report where you write up any out-ethics behavior. And then it goes into your ethics folder. But Miranda didn't let me do that, she said I had to write a Things That Shouldn't Be report.
What's the difference.
I"m not sure but I know that the Things That Shouldn't Be report would go into his "pre-clear" folder. I asked why. And she said becuse they'll handle it in session. But he didn't go into session, and I didn't understand why he didn't go into ethics.
Did you prepare this Things report?
Yes. Miranda helped me.
How?
She helped guide me how to write it and how to phrase things. I don't remember exactly what I wrote though.
But it was about certain events between you and Masterson.
I wrote up what he had just done to me, and I'm pretty sure I wrote up how our sexual relationship was.
So when you wrote this report, it was in her office?
In the ethics department.
Did she then read your final report?
She said she was going to put it in his folder, and it would be handled in session.
Were there things she asked you to change in it?
I just remember her helping me write it. I just described what happened, without anything... you have to remove, what do they call it, HE&R.
What's that?
Human Emotion and Reaction.
Did she tell you you had to remove that?
Yes sir.
Did she tell you there were words you couldn't use?
That would be "rape."
And then what happened?
She said she was going to put it in his preclear folder.
Is that when you did your ethics handling you described?
Yes sir. I remember it being about a month. Until I was to do Conditions. I don't know how to explain that.
Was this done at the Celebrity Centre?
Yes sir.
Was that a daily thing?
I was in there pretty much in there every day for months, even after we had broken up. Because after my program, when I was doing my Conditions, I asked him if he was going to go to ethics and handle it. And I had told myself based on his answer would be my decision and I would come up out of Conditions. Hard to explain.
What was his answer?
I was standing in the living room and he was a step up in the hallway, the entrance way. I asked him if he was going to go to ethics and handle it. He said no, he didn't have to becasue he was prospering in life.
You understood what that meant? What did it mean to you?
I read something called "Ethics Protection."
What did that mean?
When someone's statistics are up in life, they're called "upstats."
Based on his response, how did you feel about the relationship?
I was done. I was at the part of Conditions when you are trying to figure out which group, I can't remember what it said exactly, but you have to make a decision about relationships, and I told him I was done.
How did he react?
He did not want that to happen.
Did it end at that point, your relationship.
I remember staying there or another week or two. And we had a dog.
So at what point, first of all was it you who ended the relationship?
Yes sir. But he made his decision so that forced me to make my decision.
His decision...
He wouldn't go to ethics.
That was important to you?
I told him I don't trust you anymore.
What time did you leave the relationship?
I remember staying at a friend's house, a studio apartment down the street, and I stayed with her for about two weeks maybe.
Do you recall when that was roughly?
It was after Valentine's day of 2002. And before his birthday, which was March 13.
After you left the relationship, were there times when you had contact with each other?
Yes sir.
Once or more than once?
Yes I saw him, throughout the years.
Was there a time where the two of you together had to report something?
Yes sir.
What was that about?
We had to meet with Chris Scoggins to go over the terms of our breakup.
What did Mr. Scoggins say about the breakup? (Obj, sustained) As a result of this meeting, was there an agreement you had to sign?
Yes sir. I was to report outside of the president's office there's a... (Obj, overruled)
So you had to sign something?
Mr. Mastersron and Mr. Scoggins were sititng in the courtryard. There was a paper and a pencil. And he was writing out the terms of our breakup.
Chris Scoggins?
Yes sir.
What were the terms?
I remember it was not to sue him. And I was not going to do that, it's against...
Is that what you told Scoggins?
Yes sir.
Did you after this breakup, did you stay in Los Angeles?
I stayed in Los Angeles for about a year. Then I moved to New York.
For that year you were here, were there ever times where you reconnected with Masterson and you were intimate together?
Yes sir.
Here in LA, one time or more than once?
A couple times. I remember the first time, I was wearing a white dress, and I was at a party, and I was drunk. I went back to the house I started crying and he stopped.
So we understand, you went to your house...
It was his house. I rode with him from the party.
Were you intimate together that time?
The first time I started crying and he stopped.
There was a second time in Los Angeles?
Before I moved to New York he came over to the house where I was living.
Did you go to your house together, or he showed up?
He came over to, I was already at the house where I was living, and he came over.
Did you know he was coming over?
Yes sir.
And the two of you were intimate?
Yes sir.
How were you feeling about Mr. Masterson during that period of time after you had broken up and you were still living here in Los Angeles?
I was really happy to be out of that relationship.
But when you reconnected those two times or so, what were you feeling about him? Did you have feelings for him still?
Yes, I loved him. I was not in love with him, but I cared about him very much.
So still after this breakup.
Yes.
When you moved to New York, about a year after the breakup?
Yes sir.
And there was a time you were together with him in New York. How did that come about?
He went to New York and he called me. And I was going out to dinner with two friends and invited him out. He's now good friends with these people. We went out to dinner and out to a bar after.
Where you were living in New York, did you have a place of your own?
I was staying with friends when I moved there, and I was going to rent out a room in a friend of a friend's apartement. But after I paid her the rent, no dogs were allowed. I had a bulldog.
So you were together with some of your friends and you invited him and you went to a bar. After the bar the two of you then got together?
At his hotel room. The Tribeca Grand.
In his hotel room, the two of you were intimate there?
Yes sir.
In LA, the two times, did you have concerns about them (Obj, sustaine) When you were in New York in the hotel room that you felt was inappropriate?
The answer is yes to both questions.
Tell us the one in New York.
It was pitch black, I saw a light flash, a camera flash.
And how did you respond to the flash.
I was not happy.
What was it that was occurring?
Sex.
Was the camera flash, was that something that happened during the sex?
Yes sir.
What did you feel about that? (Obj, overruled)
He cannot change.

Two admonitions for the jury: About how Scientology policies is not for the truth of the matter asserted. But to assist you to assess the witness's actions or inactions.
Second: That Mr. Masterson is not accused of any harassment. No evidence that he's involved in it. Evidence about harassment only being introduced for the state of mind of the witnesses.
