At Los Angeles Superior Court today, Judge Upinder Kalra granted the request by Danny Masterson’s victims to lift a stay on their lawsuit against Masterson and the Church of Scientology so they can proceed with discovery.
The Jane Doe case is not just about money from civil damages. This is about bringing to Justice these inhuman individuals who believe Scientology is the ONLY ROAD to immortality and saving our planet. The time and turmoil the Jane Does went through and will go through in the next two plus years is understandable when one sees that these are brave principled individuals. Then it makes sense. The have a moral compass. I’m glad the judge supported moving forward.
Do the plaintiffs have restraining orders in the meantime? Not sure how that would read “Any and all MF’s from the COS will be arrested if they mess with the plaintiffs in any way. That includes but is not limited to family, friends, employers, pets, or maintaining or creating hate sites.”
That may seem like a long time but if you’re used to scheduling orders, there’s a lot that goes on before the trial. This is simplifying it, but they have depositions to take, other discovery requests and deadlines, all sorts of motions with cutoff dates for those, witness and exhibit lists, pretrial memos, pre trial, etc. I will be shocked if it goes to trial in a 2 year period. We have a fairly cut and dried case that got a scheduling order in January 2023 with the trial set for April 2024.
Civil cases take forever. Laura DeCrescenzo was in court, 9 years before settling on the eve of trial.

That's what I asked/exclaimed. Makes sense if DM's appeals will be used up by then, but my concern is the same as KnowingHow2No. Perhaps the Janes can petition the court to put a stop to the harassment.

By that time the clock may have run out for discovery in this lawsuit, and the plaintiffs will be out of luck as far as getting Masterson to give up evidence they might need."
Why is it so complicated they need to wait 2 years? Either the clam cult harassed and terrorized them or it didn't. All the judge needs to do is look at the evidence.

I am confused. I wish I understood more about the discovery procedure.
