That last objection from Cohen that the judge sustained (even though he declined bringing back the jury to explain) will be Cohen's main reason for appeal after DM is found guilty.

Agreed, it seems to me that everything he has done has been is geared toward an appeal, so what does that tell us, he is expecting a guilty verdict and I so hope to get it

Can he do this though especially after the judge gave him the opportunity to 'fix it' and he declined? Could the court use this argument against him?

Yes, I hate to admit that Mueller brought up something that was not supposed to be brought up. Although I can see Mueller's point for doing it, we now see he should have avoided it because it gives Cohen more ammunition. This isn't to say that an appeal will be granted (and of course this isn't to say that DM will be found guilty, necessitating an appeal to begin with, but in case he is found guilty ...) but Cohen will have a bunch of "little things" to argue for an appeal and he may actually use the judge's offer to "fix it" as his main point, stating that she admitted she would have sustained an objection had he objected at the moment Mueller brought it up. But objections during closing arguments are uncommon and there have been studies that found that jurors find it "rude" to hear objections during closing arguments. Cohen hasn't been shy about objecting at every turn and it says a lot that he didn't object during Mueller's closing. Cohen does have a point that bringing the jury back in and have it explained to them to discount that part of Mueller's comments would only raise their curiosity. So it might work in his favor that he declined the judge's offer. If DM is found guilty and if an appeal is granted, I have read somewhere that somewhere between 1/10 and 1/5 of criminal cases are overturned on appeal. Not sure where I saw that but it stuck out in my head because, even though Cohen is making far bigger bucks that Mueller's salary, I'd imagine DM has coffers available to him and would get another set of big attorneys to represent him for that 10% or 20% chance to walk. I'm jumping the gun. I do realize, like Tony said, "Nobody knows anything." ;-) I'm also not proofreading this and I realize it's a ramble. I swear, I'm at the edge of my seat on this case. I'm in Florida but I feel as if I am right there, sitting next to the proprietor, peeking over his computer screen, listening to him clicking away. I feel so sorry for these women. (I actually also feel sorry for DM's wife.)

I assumed that once the offer to object is 'gone', as Cohen declined, than he's unable to use this towards any appeal.

With 7 women and 5 men part of the jury, I hope that they really look at the facts of the evidence Mueller presented of all 4 women, even though only 3 of the women's lawsuits matter.

There is an obvious pattern in DM's behaviour. It would be hard to ignore.

Based on your reporting, Cohen really did not make a good case and you were left hanging for his "gotcha" set ups. I pray Danny Masterson is put in jail and this is one of the many lynch pins that help take down the cult called Scientology.

Five and a half years (plus some) of a relentless pursuit of justice, and now it’s in the hands of 12 jurors. I sincerely hope that, for the women’s sake, Danny receives justice, and that these ladies will be able to achieve at least a modicum of closure in their long struggle to bring their horrendous experiences into the light of day.

I find it hilarious that Mueller stressed the word “reasonable”. It’s very applicable here, but boy, that’s a bad word in Scientology!

Out of curiosity, I'm interested in knowing how Mueller presented himself in closing arguments compared to Cohen, ie., we're they calm, firm, assertive or loud and aggressive.
