This morning we described to you some of the issues that Danny Masterson’s defense attorney Philip Cohen planned to raise in today’s hearing ahead of Masterson’s retrial, which is scheduled for April 11.
Now we’ve heard from multiple people who attended this morning’s hearing, and for the first time Leah Remini made an appearance in Judge Charlaine Olmedo’s courtroom on the Masterson matter.
She was there in support of one of the victims, Jane Doe 1, who was in attendance with her Marsy’s Law attorney, Graham Berry.
Leah didn’t speak to the court, but Berry did, telling Judge Olmedo that Jane Doe 1 experienced intimidation and harassment during the first trial and as her Marsy’s Law attorney, he wanted to make the court aware of it.
Cohen objected, denying that any intimidation went on, and asked the court to obtain courthouse security footage of the hallways to examine them for these claims.
Judge Olmedo said that tapes for last October and November would not be available, and she was not going to order any review of footage.
“The judge had been unaware of the harassment and intimidation during the first trial and wanted to hear of any future issues in and around the courthouse,” Berry tells us.
Jeffrey Augustine, who was present for part of the hearing, says that Cohen also objected to Jane Doe 1 coming to the hearing at all, but Judge Olmedo allowed her to stay for the discussion of Berry’s complaints about intimidation. After that portion of the hearing, Jeffrey says, Jane Doe 1, Remini, and Berry left.
Jeffrey tells us that Danny Masterson was in attendance, as well as his wife Bijou. And Scientology’s attorney Vicki Podberesky showed up. (During the first trial, she had a couple of minions showing up in her place.)
The hearing then moved on to a lengthy discussion about Kathleen Jenkins, the Toronto woman that Deputy DA Reinhold Mueller plans to bring in as a fifth accuser of Masterson. (The three forcible rape charges Masterson is facing are based on the allegations of Jane Does 1-3. But an additional “prior bad acts witness,” Tricia Vessey, testified about being raped by Masterson in the first trial, and the prosecution wants to call Jenkins as an additional prior bad acts witness. She alleges that she was raped by Masterson at a Dracula 2000 cast party in Toronto in 2000.)
Cohen argued that Jenkins should be excluded because her allegations are 23 years old, and that they are based on claims of drugging, not “force or fear,” which is the basis of the forcible rape claims that could put Masterson in prison.
As we indicated in this morning’s story, Cohen also argued about excluding testimony about the Church of Scientology, about drugging allegations, and other restrictions.
The prosecution, meanwhile, indicated that they will be trying again to bring in Claire Headley as an expert on Scientology. Cohen’s objection kept her out in the first trial and he’s also objecting this time.
Judge Olmedo said she would issue written rulings on these matters tomorrow morning.

Scientology is a key component in this case. Scientology "religious scripture" dictates non-reporting of crimes and security checks for victims of crimes("what did you do in this and/or some other life to 'pull in' the attack?"). Scientology "religious scripture" labels reporting crimes...a crime! And further stipulates that those who do so can be harassed and "ruined utterly".
Damn, there HAS TO BE A WAY, legally, to get the scientology "religious scripture" that is a major cause of the absolute fuckery that has occurred in this case into the trial record, yes?
