I have to think that the plaintiffs have evidence that the Co$ is deeply involved in all of the harassment and are just waiting for the right time to show their cards. The amended complaint may be the best time to do that.
As for the 'fair game' crap, the defendants lawyers are just parroting the CO$ line and it is total bovine excrement. Lron only 'cancelled' the use of the words 'fair game', not that policies application.

Maybe some of them weren't an 'agent' for the defendants noted in this complaint, but they could have been agents for one or more of the other Defendants - e.g. Jenni Weiman and Danny Masterson - which means they are just trying to ensure those three acronyms are 'not liable', as they say for those specific items.
